Description of Action: State Senate introduced SCR32, a Senate Resolution outlining difficulties of implementing NCLB, especially for special needs students. Calls on the West Virginia Congressional delegation to support and seek: full federal funding for both NCLB and the Individuals with Disabilities Education Act (IDEA); an on-grade-level equivalent form of assessment for IDEA eligible students in order to resolve inconsistencies between the two acts; limiting school choice to the sub-group or groups that do not meet AYP; requiring sanctions to apply to schools or to sub-groups within schools only when the same sub-group fails to meet AYP in the same indicator in consecutive years; and elimination of the penalties on schools that have not met AYP solely because a sub-group does not meet the 95% test participation requirement
